For more than 15 years, Jay Collert has been teaching this 5-day basic environmental compliance course covering a multitude of topics. Thousands of students have benefited from the unique training which allows for attendees to immediately put into action strategies to help ensure compliance. The course is aimed at those new to the environmental field as well as experienced practitioners wanting an update. The instructors joining Jay at select locations include: Mike Brown; who has been teaching with Jay since 1994 and has taught environmental courses since 1980. Mike Owen, who has also been teaching the Bootcamp courses since 1994 and brings a tremendous amount of experience, practical knowledge, and humor to the classroom. And Joe Santarella, another long time instructor who not only brings considerable knowledge to the course, but also draws on his experience as a USEPA prosecutor for a unique view of the other side.

The topics covered during this course include:
  • Environmental Law: From statute to regulations, a look at the basis for environmental regulations, both at the federal and state level. Included in this section is an overview of environmental enforcement and the possible impact this can have on an organization and personnel, and how the role the Federal Register plays in keeping the regulated community updated and informed on the latest regulations.
  • Clean Water Act: A comprehensive overview of the 1972 Clean Water Act along with a look at the various amendments through the Oil Pollution Act of 1990. This day-long section includes a complete explanation of the permitting process, the differences between technology-base and water-quality based standards, along with a detailed look at an operating water quality permit. In addition, storm water permits, both industrial activity-based permits and MS4 permits will be described along with an analysis of the differences between the permits. In particular, the very center of the storm water permits – Storm Water Pollution Prevention Plans – will be the subject of discussion and the importance the plans play in compliance with the permits. As an ending to this section, a through explanation of the Spill Prevention Controls and Countermeasures plan will be given, to include the latest information from the USEPA regarding the biggest changes to the rule since 1990.
  • Clean Air Act: Arguably, the single most complicated and sophisticated section is the Clean Air Act. This section will cover all of the major titles of the Clean Air Act and, in particular, the Title V requirements for permitting. A complete breakdown on definitions and applicability will be given to help foster an understanding of the impacts this Act has on an industrial facility. Definitions and explanations of the National Ambient Air Quality Standards (NAAQS), New Source Performance Standards (NSPS), New Source Review (NSR), rules governing attainment and nonattainment areas, and how the New Source Performance Standards (NSPS) permitting procedures affects facilities will be included in this topic.
  • Resource Conservation and Recovery Act: This section will focus on defining hazardous waste and the intricacies of managing this waste at an industrial facility. Broken into three parts, a complete discussion of RCRA will guide attendees through the definitions of solid waste, hazardous waste to include listed and characteristic hazardous wastes, exempted wastes, mixture rule, derived-from rule, and the contained-in principle. Generator classification will be explained as well as the differences in requirements between large, small, and conditionally-exempt generators. A complete section devoted to identification of hazardous wastes will allow full understanding of exactly what is a hazardous waste, what the differences in managing the different hazardous wastes are, and the differences in liability for an industrial facility. Used oil and universal wastes are also included in this comprehensive section. The last section will be devoted to management strategies relating to hazardous waste. Satellite accumulations points, container storage areas, labeling, marking, volume and time limitations, and container issues are all explained and options given to help in managing hazardous wastes in the industrial area.
  • Comprehensive Environmental Response, Compensation and Liability Act: The clean up of inactive waste sites and the reporting of releases of hazardous substances into the environment are the two key parts of CERCLA. By way of explanation and examples, hazardous substances are defined under CERCLA and the applicability to Superfund clean up and release reporting. To help understand the Superfund portion of CERCLA, the National Priorities List, the National Contingency Plan, definitions of liability, and the concept of potentially liable parties (PRP) are discussed in detail. The question of “what is a release and when is a release reportable” will be discussed through examples.
  • Emergency Planning and Community Right-To-Know: This area will explain the four sections of EPCRA: Emergency Planning, Emergency Release Notification, Community-Right-To-Know, and the Toxic Chemical Release Reporting. To help understand these four sections of EPCRA, definitions and explanations of hazardous substances and extremely hazardous substances will be covered as well as 313-chemicals and chemical compounds. Detailed analysis of who needs to report under all sections of EPCRA with an outline of what needs to be reported will conclude this section.
  • Transportation of Hazardous Materials: One of the most overlooked environmental-related requirements, yet one of the most important is the Post 9/11 era, this section will include all of the basic requirements of hazardous materials transportation including the new security section. This fast-paced section will take everyone through the Emergency Response Guide (ERG) book, the many placards and labels required by DOT, as well as the Hazardous Materials Table in 49 CFR.
  • Toxic Substances Control Act: This section will cover the requirements and the management strategies of PCBs, Asbestos, and lead. While many organizations have tried to remove and declare themselves free of the three toxins, it has remained a problem due to the pervasiveness of the three materials. Examples will be given of past problems and enforcement actions that have fallen those who were not focusing PCB, lead and asbestos issues.
  • Storage Tank Management: Tanks, both above and below ground, will be covered in this section. The federal regulations of underground tanks will be reviewed as well as potential problems in managing the tanks for industrial facilities. Aboveground tanks, regulated at the local level, will be reviewed by looking at various standards written by professional associations.
  • EMS: An introduction to the Environmental Management System and the benefits that it can pay if implemented by organizations. The principles of the EMS will be discussed along with details on implementing a generic EMS and an overview of implementing an ISO 14001 EMS. In addition, an analysis of self-certification vs. third-party certification will be addressed in detail.
  • Environmental Training: With over 760 environmental training requirements spread out over 50 CFR volumes, it is easy to overlook vital training references. While this section does not cover all of those 760 requirements, it does cover the major areas like hazardous waste, stormwater, SPCC plans, HAZWOPER, and DOT training. The importance of documenting the training citations and integrating many training requirements into modules that will same both time and money will be explained.

Numerically indexed and color-coded, the DOT ERG helps emergency responders find vital information fast.

3. Hazmat Safety InfoPack: This is a collection of the most requested publications inserted into a pocket folder. The Infopack includes PHMSA Hazmat Safety brochure, Enhanced Security Requirements brochure, What are Materials of Trade brochure, Fumigant Marking Requirements brochure, DOT Chart 12, Hazmat Safety News - Registration, Commercial Suppliers List, Hazmat Training Module brochure, Hazmat Transportation Workshops brochure, Multimodal Hazmat Training Seminars brochure, Does Your Hazmat Training Measure Up? brochure, How to Use the HMR, UN Cylinders brochure, and Transporting Infectious Substances Safely brochure.
