In 1993, the US Supreme Court established guidelines for the admnissibility of scientific evidence and expert withness testimony. These guidelines are called the "Daubert Factors."
Every response to Environmental Regulation is, in fact, a matter of law. For example, the data one submits in response to an NPDES Permit is testimony submitted by the permittee to establish complaince. One of the basic requirements of the Daubert Factors is that, in order to be admnissible, the data must be derived from a study based on an objective planning process. When properly implemented, compliance with USEPA and State guidelines has been found by the Court to meet this test of admissibility.
In this course the student will be presented with an understanding of the scientific method, the design of experiments, and how they should be applied in Environmental testing applications.
