SPCC Final Rule

The U.S. Environmental Protection Agency is delaying the effective date of the final rule that amends the Spill Prevention, Control, and Countermeasure (SPCC) regulations promulgated in the Federal Register on December 5, 2008.

This is in accordance with the memorandum from the Office of Management and Budget entitled, “Implementation of Memorandum Concerning Regulatory Review” (M-09-08, January 21, 2009). The amendments will now become effective on January 14, 2010.

RCRA Violations

The U.S. Environmental Protection Agency today fined Alloy Processing, a metal finishing company located in Compton, Calif., $150,000 for failing to comply with federal hazardous waste management regulations.

The EPA inspected the Alloy Processing facility in Compton in March 2008, and found that the company failed to properly classify and manage hazardous wastes generated by the company, as well as other hazardous waste management violations, including:

  • Failure to submit biennial reports;
  • Failure to obtain an EPA identification number;
  • Failure to perform waste determinations;
  • Storage of hazardous waste without a permit;
  • Failure to develop and implement a personnel training program.

Clean Water Act Violations

The U.S. Environmental Protection Agency has ordered Marisco Ltd. to comply with Clean Water Act requirements at its ship repair and drydock facilities at Kalaeloa Barbers Point Harbor in Kapolei.

The company failed to implement water pollution controls outlined in its discharge permit at its main ship repair facility and the “Lil’ Perris” drydock facility, both located at Kalaeloa Barbers Point Harbor.

In December, EPA inspectors found the company at its main facility failed to have proper stormwater run-off controls and secondary containment for stormwater run-off. Workers were observed washing down work areas directly into the harbor, and concrete from cement mixing was seen overflowing into the harbor. Marisco has not had a valid discharge permit for this facility since October 2007.

At Marisco’s drydock, inspectors found the company did not maintain required records, was not properly taking water samples, did not have an updated best management plan for controlling stormwater runoff, was not implementing stormwater controls, was allowing sand blast grit to spill around the facility, and did not have spill containment for used oil drums.
