Terms & Conditions for Virtual Attendance & Online Training

Access and use of any Aarcher Institute of Environmental Training (Aarcher Institute) virtual attendance/online training course is subject to compliance by you (referred to as “you” or “user”) to the terms and conditions set forth herein. Please read this document carefully before accessing or using Aarcher Institute courses.

By accessing or viewing the Aarcher Institute virtual attendance/online training course, you agree to the following Terms of Use. If you do not agree to be so bound, you may not access or view these courses.

The terms and conditions set forth herein may be modified, at the discretion of Aarcher Institute, at any time, and any such modification shall be effective immediately upon the posting of the modified terms and conditions.

REGISTRATION

Registration for any Aarcher Institute virtual attendance/online training course will not be considered complete until payment is received and approved and registration username and password are obtained by “user.” The username and password are for the exclusive use of the “user”. Viewing an Aarcher Institute virtual attendance/online training course for which you are not registered constitutes a violation of this agreement and permits Aarcher Institute to seek immediate legal remedy.

All sales are final. No refunds will be made for “No Shows” (a “No Show” is a person who registers for an Aarcher Institute virtual attendance/online training course but who does not cancel registration or attend the event). If Aarcher Institute needs to cancel a virtual attendance/online training course, Aarcher Institute may elect to offer transfer of registration to another webinar, provided such a program is scheduled and space is available or will refund all fees that were received.

If Aarcher Institute determines that a participant must be removed from a webinar for inappropriate or illegal conduct, Aarcher Institute will not provide a full refund. Aarcher Institute is not responsible for typographic errors or user’s computer or software failure during the webinar.

Users understand that the presentation platform may require downloads, installations, or computer configurations. Users are responsible for determining computer compatibility in advance of the course.

Users understand that login ID, password, phone connection and other necessary information must be obtained at least 24 hours prior to course start time.

COMPUTER SOFTWARE AND COMPATIBILITY

Aarcher Institute is not responsible if user fails to download and test the appropriate software and computer settings before the webinar begins.

OWNERSHIP OF COURSE CONTENT

You acknowledge that Aarcher Institute owns all right, title, and interest in and to course contents, except where stated otherwise, including without limitation, all intellectual property rights (the “Aarcher Institute Rights”) specific to content, and such Aarcher Institute Rights are protected by U.S. and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works of Aarcher Institute.

USE OF MATERIALS

No content from Aarcher Institute virtual attendance/online training courses may be RECORDED, COPIED, REPUBLISHED, UPLOADED, or otherwise distributed. You may not sublicense, transfer, or otherwise make available any content to any other party for commercial purposes, internal organizational use, or financial gain, or use the content in any other media or location. You may not alter or modify the content in any way.

Users are responsible for protecting the confidentiality of user’s password and course materials.

Personal Use. Aarcher Institute virtual attendance/online training courses are made available to you for personal use only and may not be rebroadcast, retransmitted, shared, or disseminated without the express written permission of Aarcher Institute. If a registrant needs the ability to share Aarcher Institute virtual attendance/online training courses, a multiple registration license is required. Unauthorized sharing of Aarcher Institute virtual attendance/online training courses through the sharing of user names and passwords or via alternative media, or via patching phone lines is restricted by law and may subject the copyright infringer to substantial civil damages.

Aarcher Institute reserves the right to refuse service to anyone at any time without notice for any reason. Aarcher Institute virtual attendance/online training courses may be available for licensed use for larger organizations and other uses under separate licensing agreements. You agree not to sell, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on, or otherwise use, Aarcher Institute virtual attendance/online training courses in any way for any public or commercial purpose. Except as specifically agreed to by the parties in writing, you may not distribute, license, transfer or assign the Aarcher Institute virtual attendance/online training courses to any third party.

Proper Use. Aarcher Institute reserves the right, but shall have no obligation, to investigate your use of Aarcher Institute virtual attendance/online training courses, to determine whether a violation of this agreement has occurred.

GENERAL DISCLAIMER AND LIMITATION OF LIABILITY

Aarcher Institute virtual attendance/online training course materials are subject to the general disclaimers and limitations on liability for all Aarcher Institute training.

Disclaimer. Aarcher Institute virtual attendance/online training courses are provided on an “as is” and “as available” basis, with all faults. Neither Aarcher Institute nor any person associated with Aarcher Institute makes any warranty or representation with respect to the quality, accuracy or availability of the Aarcher Institute courses, content, presentation, or services. Except as expressly stated herein, Aarcher Institute disclaims all warranties, conditions, representations, indemnities, and guarantees with respect to the Aarcher Institute courses, content, presentation, or services, all components thereof whether express or implied, arising by law, custom, or prior oral or written statements made by Aarcher Institute, its representatives, third parties, or otherwise, including but not limited to, the warranties or merchantability and fitness for a particular purpose. Further, the warranties stated above will not apply to the extent that there has been: (A) use of the Aarcher Institute programs in a manner for which it was not intended; or (B) modification of the Aarcher Institute materials by anyone other than Aarcher Institute. Aarcher Institute does not warrant uninterrupted or error-free operation of the Aarcher Institute training courses, that Aarcher Institute will correct all defects or that installation; or operation of the Aarcher Institute will not affect other software or systems of the user.

Limitation of Liability. Except with respect to obligations under the indemnification section of this agreement, neither party will be liable for any consequential, exemplary, incidental, indirect, or special damages or costs including, but not limited to, lost profits or loss of goodwill, resulting from any claim or cause of action based upon breach of warranty, breach of contract, negligence, strict liability, product liability, or any other legal theory, even if advised or should have known of the possibility thereof. Each party’s maximum liability for direct damages is limited to the total fees paid and payable to Aarcher Institute under this agreement during the then current term during which the incident that gave rise to the claim occurred.

This agreement is governed by the laws of the State of Maryland.
